Man drags ex wife to court for marrying off daughter without his consent

A 65 year-old man, Nafiu Auwal on Wednesday, dragged his wife, Binta Lawal to a Sharia court sitting at Magajin Gari, Kaduna for allegedly marrying off his daughter without his consent.
The complainant accused Lawal of spoiling his daughter’s first marriage blessed with a child and married her off for the second time with the consent of his elder brother, despite my disapproval.
“She bypassed me and went to my brother in Katsina for the marriage without my consent; I had called my brother to show my disapproval, but to no avail.
“Therefore, I want this honourable court to dissolve the marriage since I did not approve of it and give me custody of my two children”,he prayed.
Auwal told the court that he had divorced his wife since 2020 after having two children among which is the married daughter.
He added that the defendant had stopped his children from visiting him, saying he had not seen them in three years.
Responding, Counsel to the defendant, A.H Dan-Mai Gauta, said his client didn’t solemnise the wedding, rather the complainant was supposed to file a suit against his brother.
“With regards to the issue of custody, the daughter seize to be subject of custody as she is a mother, while the boy is an adult.
“Therefore, we are praying court to dismiss the case,”he said.
The Judge, Mal. Isiyaku Abdulrahman,  gave Auwal an option to either dismiss the case or join his elder brother in the case as he was the one that solemnised the wedding.
He advised the complainant to bless the marriage rather than destroying it, saying he would intervene to see that his children visits him.
He also ordered the defendant to allow their children visit their father and stop involving them in their problem.
The complainant later said he had forgiven his children and blessed the marriage.
The judge adjourned the matter till March 6 for the complainant to give update on his children visitation.
